Terms of Use

1. PARTIES AND DEFINITIONS
This agreement is concluded electronically between nobetportal.com ("Platform", "We", "Service Provider") and natural or legal persons using the Platform ("User", "You").
Definitions:
- Platform: nobetportal.com website and mobile application
- Service: Shift and schedule creation support system for hospital work groups
- Administrator: User with authority to create and distribute lists within a group
- Employee: User listed and receiving notifications
2. SERVICE NATURE AND SCOPE
2.1. Services Provided
The Platform provides the following services:
- Automatic shift/schedule list creation support
- List distribution and notification sending via mobile application
- Shift exchange finding and matching functionality
- Lottery drawing and random assignment system
- Ability for users to report preferred and non-preferred days
- Administrator system for sending announcements/notices to employees
2.2. Service Limitations and Purpose of Use
IMPORTANT: The Platform is designed SOLELY as a SUPPORT TOOL and TIME-SAVING SYSTEM in the shift and schedule list creation process. The Platform:
- Is NOT a completely automatic and error-free solution
- Does NOT replace the control and approval of the administrator or responsible personnel
- Does NOT eliminate organizational responsibilities
- Is an assistant tool requiring human oversight and final approval
3. USER RESPONSIBILITIES
3.1. List Control and Approval Process
CRITICAL RESPONSIBILITY: Users must process every list created by the Platform in the following manner:
- Backup lists by copying them outside the Platform
- Manually review and verify each list in detail
- Make necessary corrections and approve the final version
- Store approved lists outside the Platform in another system or medium (Excel, Google Sheets, physical copies, etc.)
- Manage operations based on these approved lists
- Accept that they are responsible for any Platform issues resulting in list loss, reputational damage, profit loss, or indirect damages
3.2. Distribution and Communication Responsibility
Users are responsible for:
- Verifying that list distribution reaches the correct persons
- Using alternative communication methods for employees who do not receive or receive incorrect notifications
- Activating non-Platform communication channels (phone, SMS, email, etc.) in emergencies
4. DISCLAIMER OF LIABILITY
4.1. Algorithm and List Creation Errors
The Platform's list creation algorithm has the following limitations:
- May not produce perfect or optimal lists in all situations due to mathematical and logistical constraints
- May have conflicts, imbalances, or incorrect assignments with complex preference combinations
- May not fully balance seniority, preference, and intensity parameters
- Cannot account for human factors and unforeseen circumstances
- Therefore, every list created by the Platform must be reviewed by the administrator or responsible personnel, corrections must be made, and only then should it be put into use
4.2. Notification and Distribution Errors
The Platform CANNOT be held responsible for problems arising from:
- Mobile application or notification failures
- Delayed, missing, or incorrectly delivered notifications
- Email notifications falling into spam folders or being blocked
- Communication interruptions due to user errors or outdated contact information
- Third-party service provider failures (email servers, notification services, etc.)
4.3. Data Loss and System Interruptions
The Platform cannot be held responsible for:
- Data loss resulting from server failures, technical issues, cyber attacks, natural disasters, or unforeseen events
- Service unavailability during planned or unplanned system maintenance and updates
- Permanent or temporary loss of lists created in the Platform
- Technical issues in user access to the Platform
4.4. Business Disruption and Operational Issues
Due to Platform errors, deficiencies, or failures, the Platform and Service Provider accept no liability for:
- Business disruption in hospitals or healthcare facilities
- Disruption of shift or schedule arrangements
- Staff shortages or incorrect staff assignment
- Disruption in patient care or healthcare services
- Violation of administrative, legal, or regulatory obligations
4.5. Financial and Legal Liability Disclaimer
The Platform ACCEPTS NO RESPONSIBILITY for:
- Any material or non-material damages resulting from Platform use
- Business loss, income loss, data loss, profit loss, or indirect damages
- Damages suffered by third parties
- Administrative or legal penalties resulting from failure to fulfill legal obligations
5. SERVICE WARRANTY AND DISCLAIMER
5.1. No Warranty
The Platform is provided "AS IS". The Service Provider provides no warranty regarding:
- Service being uninterrupted, error-free, or secure
- The Platform fully meeting user needs
- Results being accurate, reliable, or complete
5.2. User Acceptance and Waiver
By using the Platform, the User acknowledges, declares, and commits to:
- Fully understanding the limitations and risks of the Platform
- Using the Platform solely as a support tool
- Manually reviewing all lists and accepting responsibility
- Accepting all liability disclaimers stated above
6. PROPER USE
Users agree to use the Platform in the following manner:
- Only for lawful purposes
- In good faith and honesty
- Respecting other users' rights
- Without endangering system security
7. SERVICE CHANGES AND TERMINATION
The Service Provider reserves the right to:
- Modify the Platform at any time with or without prior notice
- Temporarily or permanently suspend the service
- Suspend or terminate user accounts
8. APPLICABLE LAW AND JURISDICTION
This agreement is subject to the laws of the Republic of Turkey. Disputes arising from this agreement shall be resolved by Turkish courts and enforcement offices.
9. EFFECTIVE DATE
This agreement becomes effective when the User registers for the Platform or begins using it.
